1. OBJECT
MY FOOOD is a simplified joint-stock company registered with the RCS of Rennes under number 901 287 136, whose head office is located at 3 allée des pivoines 35830 BETTON.

As part of the use of the CKIKI Application (hereinafter the “Application”), MY FOOOD carries out various processing of Personal Data (hereinafter your “Data”) as Data Controller.
MY FOOD places confidentiality and respect for Data at the heart of its concerns.
MY FOOOD protects your privacy by ensuring the protection, confidentiality, non-alteration, availability and security of the Data that you entrust to it on all of its communication channels.
MY FOOOD undertakes to ensure that this policy, as well as its application in practice, complies with the personal data protection system (hereinafter the “Regulations in force”), in particular:
- General Data Protection Regulation No. 2016/679 of the Parliament and of the Council of 27 April 2016 (hereinafter the “GDPR”);
- Data Protection Act No. 78-17 of 6 January 1978, amended by Act No. 2018-493 of 20 June 2018;
- Decree No. 2019-536 of May 29, 2019, adopted for the application of Law No. 78-17 of January 6, 1978 relating to information technology, files and freedoms.
This policy may be subject to change depending on the legal and regulatory context, and with regard to the doctrine of the National Commission for Information Technology and Civil Liberties (hereinafter the “CNIL”).
2. PERSONAL DATA PROTECTION OFFICER
In order to ensure that its practices comply with the Regulations in force, MY FOOOD has appointed a Personal Data Protection Officer (hereinafter the “Officer”). Laurent Fontagnol
The Referent is the privileged point of contact between you and MY FOOOD regarding the protection of personal data.

3. COLLECTION OF PERSONAL DATA
The term “personal data” (hereinafter the “Data” or the “Data”) means any information relating to a natural person and allowing them to be identified, either directly or indirectly.
MY FOOOD ensures that it only collects and processes Data that is strictly necessary for the purpose for which it is processed (principle of Data minimization).
Data may be collected by MYFOOD depending on the case:
- Directly from you, when you register on the CKIKI Application;
- Via the contact form available on the Application;
- Through your partners.
It is specified that certain Data must be communicated, without which MY FOOOD will not be able to process your request or provide you with its service.
MYFOOD cannot be accused of collecting data that it has not requested to be disclosed – which will be deleted.

At the end of the indicated retention periods, the Data is anonymized – so that it is no longer possible, irretrievably, to identify you – or destroyed.
5. RECIPIENTS OF PERSONAL DATA
Internal recipients of MY FOOD
The Data is communicated within MY FOOOD.
Internally, the recipients of your Data are the people responsible for customer relations, contract execution and prospecting, administrative services (invoicing, etc.).
Recipients external to MY FOOD
Your Data may be processed in the name and on behalf of MY FOOOD by trusted service providers.
In this case, we ensure that all the service providers we work with preserve the confidentiality and security of the Data.
MY FOOOD uses service providers whose services require the processing of your Data:
- Service providers who assist in managing the Application (CRM, business management tool);
- Advertising agencies, marketing and/or web agencies that create the Application, advertising, marketing and commercial campaigns;
- Third parties who assist and help MY FOOOD to provide IT services (hardware suppliers, internet access providers, platform providers, hosting services, software solutions, maintenance and technical support services) for databases, software and applications that may contain Data about you.
These services may sometimes require access to Data in order to perform the requested tasks;
- Service providers who provide an advisory function to our company (auditor, accountant, lawyer, IT consultant, etc.);
- Service providers who ensure the maintenance of premises and paper archiving.
MY FOOOD may also be required to communicate your Data to professional institutions such as, for example:
- The jurisdictions;
- Legal assistants (bailiffs, notaries and lawyers);
- The CNIL;
- Mediation centers.
MY FOOOD does not rent or sell Data, including for commercial prospecting purposes.
MY FOOD stores your Data within the European Union.
6. SECURITY OF PERSONAL DATA
MY FOOOD undertakes to implement appropriate technical and organizational measures to guarantee a level of security appropriate to the risk incurred for the rights and freedoms of natural persons in the context of the aforementioned processing.
In particular, each MY FOOD employee is subject to an obligation of confidentiality and is made aware of the protection of personal data, particularly through training.
MY FOOOD chooses subcontractors or service providers who present a high level of guarantees regarding the implementation of appropriate technical and organizational measures so that the processing of Data meets the requirements of the Regulations in force on the protection of personal data.
In the event of an incident with an impact on the Data, MY FOOOD ensures, within the framework imposed by the Regulations in force, to notify it to the National Commission for Information Technology and Civil Liberties (CNIL) as soon as possible, after having taken note of it and to inform the Persons concerned if necessary.
7. RIGHTS OF DATA SUBJECTS
Right of access, rectification, limitation and erasure
In accordance with the “Informatique et Libertés” law of January 6, 1978, amended by law n°2018-493 of June 20, 2018, and the GDPR, as a person concerned by Data processing, you have the right:
– access to Data,
– rectification of Data,
– to the erasure of information concerning you under the conditions set out in article 17 of the GDPR,
– to the limitation of processing,
– to define general and specific guidelines defining how you intend your rights to be exercised after your death.
Right to object
You also have the right to object at any time to the processing of your Data and to this Data being used for commercial prospecting or profiling purposes.
Right to data portability
When processing is based on consent or a contract and is carried out using automated processes, you have the right to the portability of your Data. In accordance with Article 20 of the GDPR, you have the right to receive the Data concerning you provided to MY FOOOD, in a structured, commonly used and machine-readable format, and have the right to transmit this Data to another controller without our company to which you have communicated the Data hindering this.
Right to lodge a complaint with the CNIL
Finally, you can, if necessary, file a complaint with the CNIL (https://www.cnil.fr/fr/plaintes). To do this, you can contact the CNIL by mail or by telephone (information available here: https://www.cnil.fr/fr/vous-souhaitez-contacter-la-cnil).

A response will be provided to you within a maximum of one (1) month following the date of receipt of your request. This period may be extended by an additional two (2) months taking into account the complexity and number of requests.
In the event of reasonable doubt as to your identity and to the extent that it cannot be verified otherwise, MY FOOOD may request a copy of your identity document.

8. REVIEW AND UPDATE
This policy will be updated as necessary to meet the requirements of the applicable Data protection regulations.
[1] The retention periods are established as follows: retention for the entire duration of the purpose of the processing (on an active basis) then x years from the end of the objective achieved, or from the end of the contractual relationship or the employment relationship, to constitute proof in the event of litigation (legal limitation period, retention in intermediate archiving).
